1. Deposit: A non-refundable retainer is required with all bookings. The retainer will be deducted from the total fees and charges due to The Photographer. The booking may not be considered confirmed until written confirmation is received from The Photographer. The retainer is not refundable under any circumstances.
2. Payments: Payment of the balance is due as described overleaf. Please allow sufficient time for delivery and for cheques to clear. Failure to pay shall result in the contract being cancelled and sums due shall be recovered via appropriate legal means where necessary. Costs incurred thus shall be refunded by the Client to the Photographer. Any fees demanded by other parties or suppliers (eg church copyright, venue fees for photoshoots, etc) are the responsibility of The Client
3. Cancellation: Notification of cancellation or postponement must be given in writing and sent by recorded post to The Photographer. In the event of cancellation notified more than six calendar months before the event no further monies will be due. In the event of cancellation notified less than six calendar months before the event 50% of the remaining balance will be due. In the event of cancellation less than three months before the wedding 100% of the balance will be due. We strongly recommend that you obtain wedding insurance to cover the risk of cancellation.
4. Meals and refreshments: For packages including evening coverage provision it is appreciated if arrangements are made with the venue to provide the photographer and assistant(s) with a hot meal during the wedding breakfast as many hotel restaurants are not open during the wedding breakfast and will not serve food without prior notification from the client.
5. Coverage: While every effort will be made to comply with The Client’s requirements, due to weather, time, physical limitations and other external factors no guarantees can be offered in respect of the production of any particular image or scene, nor in terms of the total number of photographs or duration of video. Restrictions imposed by venues, in particular with respect to positioning of cameras and use of lighting are outwith the control of The Photographer. It is the Client’s responsibility to notify The Photographer in advance of any known restrictions.
6. Copyright: The Copyright Designs and Patents Acts assign the copyright of the images to The Photographer. Unless specifically waived in writing by The Photographer it is not permitted to copy, distribute, allow to be copied or distributed the photographs and video recordings and other material provided to The Client by The Photographer as part of the services agreed by any means, except where permitted by Clause 7 below. The Photographer may use images and footage for marketing & competition purposes.
7. Digital Files: Where a package including Hi-Res digital files has been selected The Client is permitted to make unlimited prints and electronic copies for non-commercial use.
8. Complaints: Any complaints must be received in writing within seven days of receipt of products purchased. This includes photographs, discs, albums, frames and any other special services that have been agreed.
9. Liability: In the event of loss of images or other disaster the Photographer’s total liability shall be limited to the value of fees paid to The Photographer, less the value of any goods already supplied or capable of supply.
10. Storage of Files: The Photographer will make every reasonable effort to protect digital assets from technical failure or disaster such as fire or flood, however The Photographer does not offer secure storage of digital files and images as part of any contract. For this reason it is strongly recommended that customer purchases a copy of the high-resolution files as part of their package.
11. Governing Law: Any contract made between the photographer(s) and the client(s) shall in all respects be governed by and construed in accordance with Scottish Law and the parties hereto submit to jurisdiction of the Scottish courts.
Definitions:
‘The Client’ – either or both members of the couple named on the contract
‘The Photographer’ – services provided under the terms of this contract by Love Photography and associated companies or individuals
‘Digital Files’ – image files provided electronically on physical media or by internet transmission. Files are 8bit JPEG sRGB format, and are suitable for printing to at least 15” x 10”
‘Short coverage’ – attendance from 1 hour before the ceremony until 1 hour after the end of the ceremony, to a maximum of three hours.
‘Standard coverage’ – attendance from 2 hours (1 hour for video) before the ceremony until the start of the wedding breakfast, to a maximum of six hours.
‘Extended coverage’ – attendance from 2 hours (1 hour for video) before the ceremony until the first 30 minutes of the evening reception, to a maximum of nine hours.
‘Static Video’ – one or more unmanned video cameras
‘Extended Video’ – one operated camera plus one or more static unmanned cameras where possible at the operator’s discretion
‘Deluxe Video’ - one operated camera plus one or more static unmanned cameras where possible at the operator’s discretion
